Overview:  Australia’s Partner Visa offers a pathway to unite couples under the law, granting eligible partners the right to live, work, and study in Australia.  It requires proof of a genuine, ongoing relationship and compliance with strict legal criteria.  This visa is a cornerstone for securing permanent residency through love and commitment

An applicant may be eligible for a spouse visa if the sponsor or de facto partner (including same sex partner) is in Australia (at the time the is granted) and is:

  • an Australian citizen or
  • an Australian permanent resident or
  • an eligible New Zealand citizen

For married couples, the marriage must be legally recognized in Australia.

For de facto couples, the relationship must have been at least 12 months and genuine.  This includes same sex partnerships

Applicants must also satisfy health and character requirements.

If successful initially a temporary 2-year visa is granted, which can be extended to permanent residence if the relationship is ongoing and assessed as genuine.
